LGNZ Submission to the Royal Commission of Inquiry in Building Failure caused by the Canterbury Earthquake [PDF]
The submission makes the case that local authorities are creatures of statute and can only implement established regulation. A key thrust of this submission is the need to review the definition of a moderate earthquake to increase requirements for seismic strengthening of earthquake prone buildings. The regulations made under the Building Act (2004) Section 122 are the Building (Specified Systems Change the Use, and Earthquake-prone Buildings) Regulations (2005) do not require building owners to strengthen to beyond 33% of the National Building Specification (NBS) despite good practice guidelines being that buildigs are strneghened to meet 67% of the regulations.

Local Government New Zealand welcomes the Bill as a good step in providing an environmental management regime for the Exclusive Economic Zone but make some recommendations to give better recognition to the role of regional councils and addresses cross over issues between the role of the enviornmental Proection Agency and regional councils. The submission also addresses the provision that allow regulations to be made including for charges but notes that the clauses do not identify the purposes for which charges can be set
